Arbitration Process


Requests for arbitration arise in real estate relationships when two or more REALTOR® Principals (Brokers) / Brokerages enter in to a real estate business dispute regarding which REALTOR® Principal / Brokerage is the “Procuring Cause” and is entitled to be compensated or earn a commission in a real estate transaction.

All requests to arbitrate must be made by the Complainant Broker, and received by the Association within one hundred eighty (180) days of transaction closure, or after the facts constituting the arbitrable matter could have been known in the exercise of reasonable diligence, whichever is later.

All Principal Members, where consistent with applicable law, are obligated to submit to arbitration, and be heard by the Space Coast Association of REALTORS® Professional Standards Tribunal Panel. The Tribunal Panel’s award decision is final and binding.

In accordance with the Space Coast Association of REALTORS® by-laws and local policies, Mediation is available prior to an Arbitration Hearing, however it is voluntary.
