Ombudsman Process



In accordance with the National Association of REALTORS® Professional Standards Cooperative Enforcement Agreement Statement, the Space Coast Association of REALTORS® is required to offer Ombudsman services to Realtor® members, clients, and consumers.

The Ombudsman Process can be beneficial for both REALTOR® members and consumers who need informal resolution to common misunderstandings.

Typically, Ombudsman get involved prior to a party filing an Ethics Complaint or Arbitration Request, (although in some instances this may not hold true). Ombudsman act as an intermediary to obtain information from both sides as necessary to provide an informed response.

The role of an Ombusdman is to assist resolving potential breakdowns in communication between parties. They communicate via phone, discussing the concerns of one party to the other party in hopes of resolving the concerns, restoring positive relationships, and reaching mutual resolutions.

When parties do not resolve their dispute through the Ombudsman process, the Association may offer Mediation services, enabling the parties to meet together with a Mediator. Should Mediation not be successful, the Complainant may file a formal complaint with the association if they have not already done so.

Resolution & Failure to Comply


If the matter is satisfactorily resolved between the parties, with the assistance of an Ombudsman, the formal Ethics Complaint filed (if applicable) will continue to be processed until the formal complaint is withdrawn in writing by the Complainant.

A party’s failure to comply with mutually agreed upon resolution shall entitle the complaining party to file an Ethics Complaint or continue the process where a formal complaint has already been filed. The filing deadline shall be suspended beginning with the date of the Complainant’s (or potential Complainant’s) request for informal dispute resolution service or assistance and shall resume when the informal dispute resolution procedures are concluded or terminated.
